Contact: soporte@mylocalshuttle.com and WhatsApp +52 998 118 2998 (24/7).

2. Definitions

  • Platform: the website mylocalshuttle.com and the apps MLS Rides (for Customers), MLS Drivers (for Drivers) and MLS Fleet (for Fleets).

  • Customer: a person who books or travels on a Transfer.

  • Driver: an independent person who provides Transfers through MLS Drivers.

  • Fleet: an individual or company that owns vehicles and provides Transfers with its own drivers through MLS Fleet.

  • Operating partner: a Driver or Fleet that provides the Transfer in its own name and under its own responsibility.

  • Collecting entity: Garflo Inc. for payments made on mylocalshuttle.com through PayPal, and SAF for payments of quotes and payment links sent by MLS to customers in Mexico through Clip.

  • Transfer: a private transportation service booked on the Platform: airport–hotel, hotel–airport, round trip or point to point.

  • Booking: a confirmed and paid Transfer request.

3. Acceptance

By creating an account, booking or accepting a service, the user accepts these Terms: Part I and the part that applies to them. Anyone who does not agree must not use the Platform. Booking through the Platform requires being over 18 years of age.

4. Nature of the service: MLS is an intermediary

MLS is exclusively an intermediary and a technology platform that connects Customers with Operating partners. MLS does not provide transportation services, does not own the vehicles and does not employ the drivers.

Each Transfer is provided by an Operating partner in its own name and under its own responsibility. The Operating partner is solely responsible for the vehicle, its permits, insurance and maintenance, and for the conduct of whoever drives it. MLS facilitates the booking, the communication between the parties and the collection of payment.

5. Payments

Customer payments are processed as follows:

  • Bookings made on mylocalshuttle.com: through PayPal, with a PayPal account or a card; the payment is collected by Garflo Inc.

  • Quotes and payment links sent by MLS to customers in Mexico: through Clip; the payment is collected by Servicios Administrativos Flamingos, S.A. de C.V.

  • Bookings made in MLS Rides: through Stripe.

The Collecting entity receives the payment in the name and on behalf of the Operating partner, withholds MLS's intermediation fee and delivers the remainder to the Operating partner as agreed with it.

6. Accounts and security

Each user must provide truthful and up-to-date information and is responsible for the confidentiality of their password and for all activity on their account. MLS may suspend or close accounts that breach these Terms or show fraudulent activity.

7. Permitted use

It is forbidden to use the Platform for unlawful purposes, to impersonate others, to manipulate ratings or reviews, to contact other users in order to bypass the Platform, or to attempt unauthorised access to its systems.

8. Intellectual property

The My Local Shuttle brand, its logos, apps, website and content are the property of Héctor Ventura García Flores, holder of the trademark "MyLocal Shuttle.com" (IMPI registrations 2482521 and 2486910), and are used on the Platform with his authorisation. Their use grants no licence other than personal use of the Platform in accordance with these Terms.

9. Personal data

Data processing is governed by the Privacy Notice published at mylocalshuttle.com/privacidad. The Customer's data (name, phone, flight, pickup point) is shared with the Operating partner only to provide the Transfer.

10. Limitation of liability

As an intermediary, MLS is not liable for the provision of the Transfer, for accidents, damage, loss or delays attributable to the Operating partner, nor for acts of God or force majeure: weather, road closures, demonstrations, flight changes or cancellations not reported, or orders of an authority. In any case, MLS's liability is limited to the amount paid for the Booking concerned.

11. Amendments

MLS may amend these Terms. Changes will be published on the Platform with their effective date and, for Drivers and Fleets, notified 15 days in advance. Continued use implies acceptance.

12. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Guadalajara, Jalisco, without prejudice to the rights that the Federal Consumer Protection Law grants Customers before PROFECO.

Bookings collected by Garflo Inc. are governed by the laws of the state of Texas, and any dispute concerning them shall be submitted to the competent courts of that state.

Part II. Terms for Customers (mylocalshuttle.com and MLS Rides)

14. Bookings and confirmation

Bookings are subject to availability. A Booking is confirmed only when payment is received and the digital ticket is issued. The Customer must provide correct details: name, phone number with WhatsApp, flight number, address or hotel name, number of passengers and luggage. MLS is not liable for failures arising from incorrect details.

15. Prices and payment

The price and what it includes are shown before payment. Bookings made on mylocalshuttle.com are paid through PayPal, and bookings made in MLS Rides through Stripe, in the currency indicated when booking, in accordance with clause 5. Tips are optional and belong entirely to the driver.

16. Cancellations and refunds

Each Operating partner sets its own cancellation and refund policy. It may be, for example, non-refundable, or refundable if cancelled a certain time before the Transfer.

  • Notice before payment: the policy that applies to each Booking is shown before payment and included in the confirmation. By paying, the Customer accepts it.

  • Application: MLS, as an intermediary, handles cancellations and refunds in accordance with the policy of the Operating partner of that Booking.

  • Changes of date or time: the date or time of a scheduled Transfer cannot be modified, because availability depends on the Operating partner. If the Customer needs another date or time, they must cancel their Booking, with a refund only if the applicable policy allows it, and make a new Booking.

  • Cancellation by the Operating partner: if the service cannot be provided, an alternative vehicle or a 100% refund will be offered, regardless of the applicable policy.

Any request is made by WhatsApp or to soporte@mylocalshuttle.com, stating the booking number.

17. Flight tracking and waiting times

  • Flight delays: the flight is tracked in real time and the meeting time is adjusted at no cost.

  • Airport arrivals: the driver waits up to 60 minutes after landing.

  • Hotels and addresses: the Customer must be ready at the scheduled time; the maximum tolerance is 15 minutes.

  • No-show: after that time with no contact, the service is considered provided and is not refundable.

18. Luggage

One standard suitcase and one carry-on bag per passenger are allowed. Additional or bulky luggage (surfboards, golf clubs, bicycles) must be declared when booking and may incur a charge or require a larger vehicle. Neither MLS nor the Operating partner is liable for items left behind, although every effort will be made to locate them.

19. Conduct on board

Smoking and the consumption of alcohol or substances on board are not allowed. The driver may refuse or stop the service to people under the influence of alcohol or substances, or whose conduct endangers safety, without a refund. All passengers must wear a seat belt.

20. Minors, baby seats and pets

Minors must travel accompanied by a responsible adult. Baby seats and the transport of pets must be requested when booking and are subject to the Operating partner's availability. Assistance animals are always admitted.

21. Additional charges and damage

Any additional charge (extra stops, extra luggage or other services) is disclosed and charged before confirmation. Cleaning or repair costs for damage caused by the Customer to the vehicle shall be borne by the Customer.

22. Complaints

The Customer may rate the service in the app. Complaints are received by WhatsApp or at soporte@mylocalshuttle.com, stating the booking number.

Part III. Terms for Drivers (MLS Drivers)

23. Relationship with MLS

The Driver is independent and provides their services in their own name, on their own account and without any employment or subordination relationship with MLS, SAF or Garflo Inc. They decide when to connect and which services to accept, and are responsible for their tax and social security obligations. MLS will apply the withholdings that tax legislation requires of digital platforms.

24. Requirements

The Driver must meet, and keep current, all the legal requirements demanded by the authority of the place where they operate to provide passenger transportation through digital platforms, including:

  • A driver's licence of the type required for this service.

  • Registration, permit or certificate before the relevant mobility or transportation authority, including airport access permits where applicable.

  • A vehicle that complies with applicable regulations, with current registration card and inspection.

  • Current insurance with civil liability and passenger coverage.

  • Official identification, tax status certificate (RFC) and, where the authority requires it, a certificate of no criminal record.

MLS may request copies of these documents at any time and may reject or suspend registration if they are not met.

25. Obligations during the service

  • Arrive punctually at the pickup point and respect the waiting times of Part II.

  • Keep the vehicle clean, in safe mechanical condition and with an appropriate personal presentation.

  • Obey traffic laws, never drive under the influence of alcohol or substances, and never use the phone while driving.

  • Follow the indicated route or the most efficient one, and never charge the Customer fees not authorised on the Platform.

  • Not offer services outside the Platform to Customers obtained through MLS.

  • Report any accident, incident or complaint immediately.

  • Protect the Customer's data and use it only for the Transfer.

  • Register their cancellation and refund policy on the Platform, keep it up to date and honour it in every Booking.

26. Economic conditions

The fare, the intermediation fee, and the frequency and method of payment are agreed individually between MLS and each Driver in a private commercial agreement, which forms part of these Terms. Tips belong entirely to the Driver.

27. Quality, suspension and removal

Customers rate each service, and MLS may set quality standards, which it will communicate through the app. MLS may suspend or remove a Driver for expired or false documents, violent or discriminatory conduct, driving under the influence of alcohol or substances, improper charges, diverting Customers outside the Platform, or repeated failure to meet the standards. The Driver may leave at any time, completing the services already accepted.

Part IV. Terms for Fleets (MLS Fleet)

28. Relationship with MLS

The Fleet is independent and provides Transfers in its own name, with vehicles it owns and drivers who depend exclusively on it. There is no employment relationship between MLS and the Fleet, nor between MLS and the Fleet's drivers.

29. Permits and insurance

The Fleet is solely responsible for obtaining and keeping current all the permits, concessions, registrations and insurance required by law for its vehicles, its drivers and its operation in every city where it provides service. Its drivers must meet the requirements of clause 24. MLS may request copies of these documents at any time.

30. Management of drivers and vehicles

From MLS Fleet, the Fleet assigns drivers and vehicles to the services it accepts. The Fleet undertakes to:

  • Register only drivers and vehicles that meet the requirements, and keep their documents current.

  • Ensure its drivers comply with the obligations of clause 25.

  • Immediately remove from the app any driver who stops working with it.

  • Not assign a service to a driver or vehicle other than the one registered.

  • Register its cancellation and refund policy on the Platform, keep it up to date and honour it in every Booking.

31. Payments

MLS, through the Collecting entity, pays the Fleet for the Transfers completed by its vehicles. The Fleet is in charge of paying its drivers and is solely responsible for their wages, benefits, taxes and contributions. The fare, the intermediation fee and the payment frequency are agreed in a private commercial agreement between MLS and the Fleet.

32. Liability of the Fleet

The Fleet is liable to Customers and to MLS for the conduct of its drivers, the condition of its vehicles, insurance and permits. It undertakes to hold MLS, SAF and Garflo Inc. harmless from any labour, tax, administrative or third-party claim arising from its drivers or vehicles.

33. Suspension and removal

MLS may suspend a driver, a vehicle or the entire Fleet for the causes in clause 27, for expired documents or for repeated breaches. The Fleet may leave by written notice, completing the services already accepted.
